A MAN from Rhyl who committed a third breach of his suspended sentence has been jailed.

Owen Kelliher, 22, of West Parade, was sentenced to five months’ imprisonment at Mold Crown Court today (July 29).

He admitted the breach, by virtue of missing a planning probation appointment, during today’s hearing.

Barrister Ember-Jade Wong told the court that, on February 16, 2021, Kelliher was searched at Warrington Bank Quay railway station, and was found to be in possession of 27.9g of cannabis.

This was thought to have had a street value of up to £250, while analysis of his mobile phone found numerous messages relating to the supply of cannabis.

At Liverpool Crown Court in January 2022, Kelliher was handed a suspended sentence, as well as 120 hours of unpaid work, and 20 days’ rehabilitation activity requirements.

Peter Barnett, representing Kelliher, said his client was “realistic” given this represented a third breach of the sentence.

He had moved to the Rhyl area following the initial offence, but Mr Barnett said that his Rhyl address is “no longer available to him”.

Sentencing, Judge Niclas Parry revoked the outstanding terms of Kelliher’s community order.

Kelliher will serve half of his five-month sentence in prison, before he is released under supervision.

Judge Parry told Kelliher: “The two reasons why you were dealt with leniently were because you were young and had no previous convictions.

“The courts do everything they can not to send young men like you to prison unless they absolutely have to.

“Clearly, we have run out of chances.”
