A MAN from Abergele who shared private sexual imagery of a woman without her consent has lost an appeal against his conviction.
Kevin Berger, 44, of Lon Dirion, was convicted of disclosing a sexual photograph with intent to cause distress at Llandudno Magistrates’ Court on May 30.
At Caernarfon Crown Court today (November 24), his conviction was upheld following an appeal.

The court heard that, in June 2022, he shared such imagery without the consent of the woman who appeared in it, intending to cause her distress in doing so.
Judge Nicola Saffman, presiding over today’s hearing along with magistrates, rejected the appeal, saying she was satisfied that Berger had sent the posts in question himself.
She adjourned Berger’s sentencing to Friday, January 12, reserving it to herself, and ordered a pre-sentence report to completed on his behalf in the intervening period.
Berger was granted conditional bail for the time being, prohibiting him from contacting the woman directly or indirectly, and from making any reference to her on social media.
