A MAN from Rhyl is set to be sentenced after admitting escaping from lawful custody.

Jack Hubbersty, 25, of Maes Y Parc, pleaded guilty to the charge at Mold Crown Court this morning (July 14).

The court heard that, on June 12, Hubbersty escaped from lawful custody at Maes Y Parc.

He was also charged with assault and intentional strangulation at Maes Y Parc on June 11 and 12 respectively, but denied both.

Catherine Elvin, prosecuting, said that the Crown Prosecution Service would offer no evidence to either charges, so both were dismissed.

Ms Elvin added that Hubbersty had a previous escape from lawful custody on his record, and that this offence saw him breach a suspended sentence.

Earlier this year, the court heard, he had been sentenced to 18 months’ imprisonment, suspended for two years, for affray.

Judge Timothy Petts, presiding over the hearing, adjourned Hubbersty’s hearing until August 7.

Hubbersty has been remanded in custody for the intervening period.

“Your position is rather perilous, given you’re going to be in breach of a suspended sentence,” Judge Petts told him.

“I will give you the benefit of finding out from the probation service how you’ve been doing, but even if you’ve been doing well, there’s no guarantee you’ll be out immediately.”
